Principles of privacy protection and personal data processing

INFORMATION ON THE PROCESSING OF PERSONAL DATA

 

Based on Article. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as "GDPR").

 

I. PERSONAL DATA ADMINISTRATOR

 

The administrator of personal data is Farmepo spółka z ograniczoną odpowiedzialnością (hereinafter also Farmepo) with its registered office at ul. Gdańska 32/8 in Bydgoszcz. III. OBJECTIVES AND BASIS OF PROCESSINGRUNNING

 

Your personal data will be processed for the following purposes and on the basis of:

 

  1. receiving information about clinical trials conducted by Farmepo - in accordance with Art. 9 section 2 letter a GDPR,

  2. keeping and storing medical records, to which Farmepo is obliged as a medical entity - in accordance with Art. 9 section 2 letter h GDPR in connection with joke. 24 of the Act of November 6, 2008 on Patient Rights and the Patient Ombudsman and the Regulation of the Minister of Health of April 6, 2020 on the types, scope and templates of medical documentation and the method of its processing,

  3. direct marketing of Farmepo's own services and products - based on the legitimate interest of the administrator - in accordance with Art. 6 section 1 letter f GDPR, which Farmepo considers marketing activities to be,

  4. market research, patient satisfaction research and quality control of interviewers' work - in accordance with Art. 9 section 2 letter a GDPR,

  5. statistical and analytical - based on legitimate interest Farmepo - in accordance with Art. 6 section 1 letter f GDPR, for which Farmepo recognizes the analytical and statistical activities undertaken,

  6. pursuing claims related to the business activity conducted by the administrator - pursuant to Art. 6 section 1 letter f of the GDPR, as the so-called Farmepo's legally justified interest in which Farmepo considers the possibility of preserving evidence to establish, pursue or defend possible claims,

  7. keeping accounting books and fulfilling Farmepo's tax obligations - pursuant to Art. 6 section 1 letter c GDPR in connection with joke. 74 section 2 of the Act of 29 September 1994 on Accounting,

  8. providing personal data, including health data, to entities cooperating with Farmepo - in accordance with Art. 9 section 2 letter a GDPR.

 

IV. RECIPIENTS OF PERSONAL DATA

 

The recipient of your personal data is Farmepo and entities processing data on the basis of an agreement with the administrator and only in accordance with the administrator's instructions. Personal data may also be transferred to entities authorized to receive them under the law.

 

V. DATA STORAGE PERIOD

 

Your personal data processed on the basis of the consents granted will be processed until you withdraw your consent or, in the case of data processing based on the legally justified interest of Farmepo, until an effective objection is raised. If we have created medical documentation, we are obliged to keep it for at least 20 years from the date of the last entry in it. Subject to this deadline, if your data was processed by us for the purpose of pursuing claims, we process the data for this purpose for the period of limitation of claims resulting from the provisions of the Civil Code. We process all data processed for accounting and tax purposes for 5 years from the end of the calendar year in which the tax obligation arose. After the above-mentioned periods, your data is deleted or anonymized.

 

VI. RIGHTS OF PERSONS TO WHOM THE DATA CONCERN

 

You have the following rights related to the processing of personal data:

 

  1. the right to access your data,

  2. the right to rectify personal data,

  3. the right to delete personal data or limit processing,

  4. the right to withdraw consent. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. You can exercise the right to withdraw consent by sending a request to the e-mail address: office@farmepo.com or the address of Farmepo's registered office with the note "Data Protection Inspector",

  5. the right to transfer data, i.e. the right to receive personal data from Farmepo in a structured, commonly used, machine-readable IT format. You can send this data to another data controller or request that Farmepo send the data to another controller. However, Farmepo will only do this if such a transfer is technically possible. The right to transfer personal data applies only to data processed on the basis of your consent or contract,

  6. the right to object - in cases where Farmepo processes your personal data on the basis of its legitimate interest. You may raise an objection due to your particular situation to the e-mail address: office@farmepo.com or the address of Farmepo's registered office with the note "Data Protection Inspector".

 

VII. RIGHT TO MAKE A COMPLAINT

 

You have the right to lodge a complaint with the President of the Personal Data Protection Office.

 

VIII. INFORMATION ABOUT THE REQUIREMENT/VOLUNTARYNESS OF PROVIDING DATA

 

Providing personal information is voluntary.

 

IX. INFORMATION ON THE TRANSFER OF PERSONAL DATA OUTSIDE THE EEA

 

Personal data may be transferred outside the EEA, while maintaining the principles set out in Chapter V of the GDPR.

 

X. INFORMATION ABOUT PROFILING

 

The data is not subject to automated profiling. For the purposes of selecting clinical trials appropriate for you, we will use data obtained from you as part of health surveys and medical records, provided that you have consented to other entities providing you with medical services providing us with health data or other information provided during contacts. from Farmepo
